The problem is that on the one hand, as the general rules of intellectual property state,  supporting inventors through granting patents (as a document indicating ownership and the right of exclusive use) involves the disclosure of information concerning inventions, and on the other hand, the country's defense imperatives require having to maintain confidentiality as related to these inventions. For this purpose, the question raised is that of whether the material rights capable of being granted to inventors in defense industry, and totally speaking, the way those inventors are supported should be the same as the way other inventors (i.e. non-defense inventors) are supported. In the present article, we seek to make a comparative study of the material rights capable of being granted to inventors in defense industry in China, Russia, the United States and Iran with library method in an effort to detect and introduce a convenient legal system as for inventors' material rights in defense industries in these countries. Finally, it is concluded that, firstly, due to inevitable limitations that follow from the confidentiality of defense inventions and the Administration's supervision over how these inventions are employed, making a payment as compensation or reward on top of exclusive property right is increasingly logical and closely aligned with defense and economic interests, and secondly, issuing patents in order to support the inventors in defense-related industries is far from colliding with the basics of intellectual property law.}, keywords = {inventing the defense industry,material rights,patent right,Compensation,owner of the invention}, title_fa = {حقوق مادی مخترعین صنایع دفاعی (مطالعۀ تطبیقی در چین، روسیه، آمریکا و ایران)}, abstract_fa = {نحوۀ حمایت از مخترعین صنعت دفاعی از چالش‌برانگیزترین موضوعات حقوق مالکیت فکری به‌حساب می‌آید. مسئله این است که از یک‌سو، طبق قواعد عام حقوق مالکیت فکری، حمایت از طریق اعطای پتنت (به‌عنوان سندی دال بر مالکیت و حق بهره‌برداری انحصاری) مستلزم افشای اطلاعات مربوط به اختراع است و از سوی دیگر، ضرورت‌های دفاعی کشور، اقتضای حفظ محرمانگی این اختراعات را دارد؛ به همین دلیل این سؤال مطرح می‌شود که آیا حقوق مادی قابل‌اعطا به مخترعین صنعت دفاعی و در کل، روش حمایت از این مخترعین باید همانند روش حمایت از سایر مخترعین (مخترعین غیردفاعی) باشد؟ در مقالۀ حاضر، درصدد هستیم مطالعه‌ای تطبیقی در خصوص حقوق مادی قابل‌اعطا به مخترعین صنعت دفاعی در کشورهای چین، روسیه، آمریکا و ایران انجام دهیم تا با بهره‌گیری از تجربیات این کشورها، نظام حقوقی مناسب در خصوص حقوق مادی مخترعین صنعت دفاعی را شناسایی و معرفی کنیم؛ در نهایت چنین نتیجه می‌گیریم که اولاً به دلیل محدودیت‌های اجتناب‌ناپذیر ناشی از محرمانگی اختراعات دفاعی و نظارت دولت بر بهره‌برداری از این اختراعات، پرداخت مبلغی به عنوان غرامت یا پاداش در کنار حق مالکانۀ انحصاری کاملاً منطقی و همسو با مصالح اقتصادی و دفاعی بوده و ثانیاً، صدور گواهی برای حمایت از مخترعین صنعت دفاعی، هیچ مغایرتی با مبانی نظام حقوق مالکیت فکری ندارد.}, keywords_fa = {صنایع دفاعی,حقوق مخترعان,پژوهانه,حقوق مالکیت فکری و اختراع,گواهی اختراع}, url = {https://dpj.ihu.ac.ir/article_204936.html}, eprint = {https://dpj.ihu.ac.ir/article_204936_fe1ab4a1c43379495007c6d56d14a01f.pdf} }
